I myself hate the fact that people are opening the Collectable Minifigures.  I find it ridiculous.  And they do not refund you.  I bought from a German company on Amazon where it stated nowhere that the packets were opened.  When they arrived the series 5 Mobsters case was opened because it had a bent plastic look.  I was pissed as I resell them myself.  Anyway,  the feel method works fine and people really dont need to sell these minifigures opened and resealed.

When you contacted the seller before you purchased the items, did you ask if the items were new" or "sealed"? Also did you ask to return or just jump to a SNAD case?

i always ask if description is vague. about half the time i get SNADed. still working with the seller on the last case, but not looking good. i always give them the benefit of the doubt and try to work it out/replace. however, if i get attitude instead of cooperation SNAD it is.

This is nothing new on eBay.  I need to put some of my sealed CMF packs on BC and let you guys buy from me

What I meant was if you ask if it is new and the seller thinks it is, they will say yes. If you ask if something is sealed the seller has a better idea what you want. Anyone who parts out sets lists them as "new" even though they are opened. Not saying the definition is right or wrong, just that's how most sellers list their items.

i suppose it depends on the expectation, no one expects parts to be in sealed packs when listed as new. however, it is still kind of bending the rules on "new" items. if i were a POS i could win the SNAD case unless its repackaged/sealed and barcoded (handmade items clause)

like i said. i always ask if there is not description, or its vague. pictures are mostly stock with the figs on ebay/amazon, or packs are pictured. not interested in listings when looks like a fig out of package.

On ebay under toys there's only two descriptions...

To me an opened CMF to verify contents would be listed as New but it should be clearly described as such in the description and picture(s).

would help if ebay would ad the "new other" condition category to the toys categories as well.  Opened new stuff could then go into there.  Also new in distressed boxes / open boxes with sealed bags and such.  They have it in a lot of categories but still not in some important categories like toys and other ones as well.

 

 

 

I don't sell minifigs or part out but the subcategory would help the situation out for those that do.

You don't buy from amazon or any other online retailer I believe they all use stock photos

Sellers who do not answer emails about valid clarifying questions about their items.  

When I asked if light / sound brick was still working AFTER reading through their incomplete descriptions, that meant I wanted the item enough to ask the question and expected an answer darn it.  

Splitting hairs on new and used via eBay's policy? This seems like an argument that can go two ways. I collect and sell CMF it's what got me into this wondering what to do with my doubles before I learned to smooth. I sell my pre smoosh loose CMFs and my post smoosh sealed minis. I always list my minis with photos I take myself so you either get the bag or the figure in the pic. I am generally leery of people who use stock photos, no offense meant there. I think it is unfair to describe something as used that honestly isn't. As a seller you know I'm the collectible world used=price reduction. So as a buyer I appreciate your pain but it is on you to find a listing that says sealed bag to help validate your desire to have just that. I doubt a lot of sellers want to list anything they know is new as anything but new. I tell my kids this but the only way not to be a victim is to not leave your fate in someone else's hands in this case eBay's definition.

I am a seller that calls them new.

If I part out a set (minifigs), are they used because I sliced open a big bag to take the minifigures out?

I don't use stock photos on sets like that and I also list a good description of what was done so it isn't a surprise.

I like to list with stock photos. I describe the item as not mint and request buyers to contact me first if they are concerned about box condition. A soon as they contact me I ban them. Frustration and hissy fit free. I won't sell any other way on ebay.

Well it may sound a little harsh but 90% of our ebay revenue is clothing sales and when your feet are held to the fire 24/7 by ebay you quickly learn to protect your investment in your ebay business by any means allowed.
