We have stumbled upon a collection of Star Wars minifigures which we would like to resell. Well the catch is: the minifigures are in real great condition. No scratches, all shiny and not a sign of dust or stains.

 

The question is: how does one determine whether a minifigure is to be listed as new. I know, this might be the dumbest question you've read all day.

 

Do LEGO vendors actually list these minifigures as new items based on the looks of the item rather than the freshness? It is something we've been wondering for a while. Now that we've seriously considered investing in minifigures, we feel like it's something we should know.

I would list them as used even if they look brand new.  Your description can tell buyers how great of condition they are, but I would still consider them used since they are out of package. 

the real question is what the definition of "is" is?  

You are better off listing as used and say excellent condition. I do list some minifigs as new if I buy them and take them out of the bags. Buying them from someone else and listing as new is a bit shady. For all you know they could have all been in some kids mouth. 

When it is out of the original package, don't say it's new. 

Unless you personally removed them from the inner bags, list as used.

also in the camp for; if you didn't remove it from the manufacturers packaging yourself, it's not new. nor is it new if it's ever been assembled (even "just for shipping")
