I would lean toward #3. I've been in similar situations with sellers on Bricklink and eBay and always try and give them a chance to respond/fix the issue. I am very intolerant of smoke smell and feel that it should always be mentioned in a listing or store if it's a possibility.

Disney should first purchase it then.

Saw these at the Lego store in Miami.

I feel like this is more iconic than the Tumbler, though, right? When you think of what Batman drives, I imagine this is what many AFOLs picture.

I’ve had this happen. First contact the seller and ask them what they’d like to do to make it right. Mine assured me he “doesn’t smoke in the house” but I responded with - dude, it’s really bad and really obvious. It was a small order so he ended up refunding me. But I left neutral feedback, stating that there was no mention of smoking, and the items arrived smelling of smoke. At least give the seller the chance to make it up to you.

I always start with an email and word it accordingly to what kind of outcome i want. If you are ok keeping the parts, then i would be looking for a discount.

I think in this particular case, it’s appropriate for this minifig. If you think back to the 89 Batman movie, that “cape” was more of a plastic thing that an actual piece of cloth.

Bought this lot on EBay recently: Finished inventorying and rebuilding them - very clean and no pieces missing. Manuals included. Paid $175 and used $10 in EBay Bucks to bring the price down to $165. I have all of these still MISB in my personal inventory (except the Mini which I already built). Given that the F40 is heading towards $300 territory on FBA, I figured it was worthwhile picking these up for ~$40 each used. The MISB sets will end up on FBA or EBay in the near future (though for the T1 I am not sure when that will be, and how long it will take for the millions of copies amassed by resellers since 2011 to disappear). I loved the builds - lots of interesting tricks used in putting these cars together. Previous owner was a collector and was meticulous about sticker placement, which is a plus.
